国际农产品贸易自由化进程中的农业环境政策问题评析

摘要在全球化、可持续发展和机制化相互依赖的复杂环境时代，由于GATT第20条(b)项和(g)项环境保护例外条款的不确定性，WTO《农业协定》“绿盒子政策”的缺陷及各国利益的驱动，农业环境政策问题是在平衡自由贸易与环境保护两种价值中区别于一般环境政策问题的特殊环境政策问题。在研究国际农产品自由贸易与农业环境政策的国际立法、实践及不足的基础上，探讨农业“多功能性”理论的社会环境功能，以实现国际农产品自由贸易与农业环境保护的“双赢”。

Abstract： In the complicated environment age of mutual reliance among globalization, sustainable development and mechanism, because of the uncertainties of the exceptional terms in GATT articles 20(b) and (g) and the defects of WTO Green Box and the spurs of national interests, the agricultural environment policy is special and different from other general environment policy in the two values of balanced free trade and environment protection. On the basis of analyzing the legislations, practices and the shortcoming of free trade of international agricultural products and agricultural environment policy, the author explores the social environment function of the agricultural multi-function theory in order to realize the win-win of free trade of international agricultural products and agricultural environment protection
